All users who choose to purchase notarial services from Rainier Signing Services, LLC choose to interact with Rainier Signing Services, LLC in ways that require Rainier Signing Services, LLC to gather personally identifying information. The amount and type of information that Rainier Signing Services, LLC gathers depends on the nature of the interaction. For example, we ask visitors who wish to have a document notarized to provide a picture of their government-issued photo ID. 

The security of your Personal Information is important to us, however, no method of transmission over the Internet, or method of electronic storage is 100% secure. While Rainier Signing Services, LLC uses commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. However, you can rest assured knowing that Rainier Signing Services, LLC does not disclose your personal identifying information unless necessary as part of the identification verification that is to be provided or compelled under court order.

Indemnification: You agree to indemnify, defend, and hold harmless Rainier Signing Services, LLC, its officers, directors, employees, agents, and third parties, for any losses, costs, and liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the site(s) or services, any user postings made by you, your violation of any terms of this Agreement, or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations.  Rainier Signing Services, LLC reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Rainier Signing Services, LLC in asserting any available defenses. 

Arbitration: 

In the event, that the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.  

Class Action Waiver:  

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, AND/ OR REPRESENTATIVE PROCEEDING, SUCH  AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE  OTHER. Further, unless both you and Rainier Signing Services, LLC agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. 

 Liability Disclaimer:

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE(S) MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. RAINIER SIGNING SERVICES, LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE(S) AT ANY TIME.   RAINIER SIGNING SERVICES, LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE(S) FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND.  RAINIER SIGNING SERVICES, LLC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAINIER SIGNING SERVICES, LLC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE(S),  WITH THE DELAY OR INABILITY TO USE THE SITE(S) OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS  OBTAINED THROUGH THE SITE(S), OR OTHERWISE ARISING OUT OF THE USE OF THE SITE(S), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF RAINIER SIGNING SERVICES, LLC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE(S), OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE(S).

Termination/Access Restriction:  

Rainier Signing Services, LLC reserves the right, in its sole discretion, to terminate your access to the site(s) and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington, and you hereby consent to the exclusive jurisdiction and venue of courts in Washington in all disputes arising out of or relating to the use of the site(s). Use of the site(s) is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.  You agree that no joint venture, partnership, employment, or agency relationship exists between you and Rainier Signing Services, LLC as a result of this agreement or use of the site(s). Rainier Signing Services, LLC’s performance of this agreement is subject to existing laws and legal processes, and nothing contained in this agreement is in derogation of Rainier Signing Services, LLC’s right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the site(s) or information provided to or gathered by Rainier Signing Services, LLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.  Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Rainier Signing Services, LLC with respect to the site(s) and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Rainier Signing Services, LLC with respect to the site(s). A printed version of this agreement, and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be written in English.  

Changes to Terms:  

Rainier Signing Services, LLC reserves the right, in its sole discretion, to change the Terms under which rainiersigningservice.com and/or rainiersigningservicesllc.godaddysites.com is offered. The most current version of the Terms will supersede all previous versions. Rainier Signing Services, LLC encourages you to periodically review the Terms to stay informed of our updates.   

Fees Policy: 

Rainier Signing Services, LLC fees policy is as follows: ALL Mobile Travel Fees Deposits are to be paid a minimum 48 hours in advance of the scheduled signing session via Rainier Signing Services, LLC's acceptable methods of payment (which are cash, Zelle, Venmo, CashApp, Square, credit/debit) including the payment link(s) on the site(s). 

For Marriage Officiate services, a deposit of fees for the marriage license fee and mobile travel fee, decorative marriage certificate fee, and 50% of the Marriage Officiate Fee deposit are required two (2) weeks in advance minimum. The remaining 50% of the Marriage Officiate fee will be due the day before the Marriage ceremony takes place, at the rehearsal. 

ALL Correctional Facility Fees along with the per single signature notarization fees are required to be paid in full before the notary goes into the Correctional Facility. For ALL Correctional Facilities, the Mobile Travel Fee is required to be paid 48 hours in advance.

RON (Remote Online Notarization) Fees must be paid 24 hours in advance before the signing session.

RON (Remote Online Notarization) Policy:

The document(s) are to be uploaded to the Secure Server Link 24 hours in advance of the scheduled signing session. The document(s) is/are to be uploaded as separate flattened PDF file(s). The document(s) must be complete. All blanks must be filled in before uploading except for the signer(s) initials, signatures, and dates. The session will be limited to 30 minutes unless otherwise stated.  The computer, camera, microphone, chrome browser, and internet must be set up and in working order. It also must allow for screen sharing, screen recording, and pop-ups. Technical support is limited from the notary during the signing session.  

Failure to sign the participant(s) knowledge-based authentication quiz (2 attempts) or credential analysis can result in an added fee for a credible witness ($20.00/per credible witness). The Notary will wait for signing participant(s) up to 15 minutes from the scheduled session start time before the cancellation/reschedule policy goes into effect.  Please make sure everything is working properly prior to your scheduled appointment.

Cancellation of your appointment Policy: 

Rainier Signing Services, LLC’s cancellation policy is as follows: There is a 25% cancellation fee if your appointment is canceled at the 24th hour mark, minimum, or more prior to your appointment. If you cancel your appointment within less than the 24-hour period, there will be NO REFUNDS. A 24-hour or more notice of canceling your appointment is required for a refund of the Mobile Travel Fee, and the 50% Marriage Officiate Fee, and Rainier Signing Services, LLC will refund you your deposit after the 25% cancellation fee is deducted.  The 25% cancellation fee will still apply regardless of if you reschedule or not. There are no additional fees to reschedule your appointment.

Rescheduling Policy:

If you need to reschedule your appointment, Rainier Signing Services, LLC will honor the previously paid deposit fees, from the original appointment that was scheduled and canceled, and apply it to your rescheduled appointment. If you cancel the rescheduled appointment, there will be NO REFUNDS of your previously paid deposits.  Rainier Signing Services, LLC is a “schedule based” company. Please understand that time is money and those scheduled slots that were cancelled cost Rainier Signing Services, LLC and the Notary money by not having that slot open to schedule another client. 

Refund Policy: 

REFUND POLICY for Rainier Signing Services, LLC is as follows:

In regard to RON (Remote Online Notarization), 100% of fees will be refunded for these reasons only: 

  Failure of signing participant(s) computer equipment or software.

  Failure of signing participant(s) internet connection.

Refunds can take up to approximately 10 business days based on the payment method you used. 

WA State Sales Taxes may apply.

FREE RE-DOS ONLY, if ID Photos and/or FD-258 Ink Fingerprinting Cards were rejected by the applicable Agency you sent them to.  An official letter from the applicable Agency and the ID used at the initial appointment are required for free re-dos. If there was an error on the Notary’s part, a FREE RE-DO will be honored to correct the error at no additional expense. ALL FREE RE-DOS will only be honored within 30 days of your initial appointment with the Notary. No additional fees will be charged and there will no refunds for the ID Photos and/or FD-258 Ink Fingerprint Services.

FREE RE-DO(S) means that you will not be charged for the Notary to go back out to you, within 30 days of the original appointment, and correct the error the Notary made on the service they provided for you originally.

There are NO REFUNDS and NO FREE RE-DOS for any errors on your behalf which includes: 

if your documents were prepared/filled out wrong, 

if you don’t sign your name and date properly,

if you use the wrong color ink pen for signing your documents,

if you use the wrong Notarial Act Certificate for notarization, 

if you damage, lose, or open the sealed envelope containing the fingerprints, 

if you damage or lose the ID photos, 

if you damage, lose, your I-9 document

if you separate, damage or lose the Notarial Act Certificate/Page from the paper(s) it was attached to, This applies to all services Rainier Signing Services, LLC offers.

If the client's paperwork was notarized, or the I-9 was verified and the paperwork had to be rewritten, re-done, or altered in any way, there are NO FREE RE-DOS and NO REFUNDS. The client will have to pay for the service(s) requested as well as for the mobility travel fee, again.

If the inmate client's paperwork was notarized, and the paperwork had to be rewritten, re-done, or altered in any way, there are NO FREE RE-DOS and NO REFUNDS. The client will have to pay for the service(s) requested as well as for the mobility travel fee and prison/jail service fee, again.

If the client damages, loses, the ID photo(s), damages, loses or opens the sealed envelope the FD-258 Ink Fingerprint Card(s) is/are damaged, lost, or the client used the wrong ink color, filled out the document(s) wrong, such as the I-9 form(s), or the Notarized document(s), they will have to pay all of the fees associated with that service as well as the mobility travel fee and jail/prison service fee, if it applies to them, again.
